Irving Arrest Records

Under Texas law, an arrest can be made with or without a warrant if there is probable cause or a reasonable belief that a person committed a crime or is suspected of an offense (Article 14 of the Texas Criminal Code). In Irving, the suspect is taken to the Irving Police Department or the Irving City Jail, which is designed for the temporary confinement of pretrial individuals. The police officer will begin a booking process that includes documenting the arrest, taking photos and fingerprints, and placing the individual in cellblocks.

The Irving Police Department utilizes a Crime Information Center (CIC) that centralizes and gathers information about criminal activities, including arrests. Each information and arrest-related file populates jail rosters, court records, Dallas County Arrest Records, and the statewide computerized criminal history (CCH) records.

Are Irving Arrests Public Record?

Yes. Following the Texas Public Information Act, arrest records such as jail custody reports are public information for inspection during regular business days (Sec. 552.002). However, certain arrest information in Irving, Texas, may be confidential and inaccessible. Specifically, information related to:

  • Identifying information of crime victims and informants (Sec. 552.1315)
  • Details from active investigations (Sec. 552.108) or criminal cases
  • Personal information of current or honorably retired peace officers (Sec. 552.1175)
  • Juvenile case records.

Irving's arrest records may be public, but specific information remains withheld unless the requester has a direct and tangible interest. This includes the subject of the record or a person's authorized representative, especially if there is a legitimate need for the information (Sec. 552.023).

Irving Crime Rate

The FBI's Uniform Crime Reporting (UCR) Program collects data from law enforcement agencies nationwide, including Irving, to generate crime statistics. According to the 2019 UCR crime report, violent crime recorded 617 incidents, with notable crimes like robbery (294), aggravated assault (262), rape (56), and murder & non-negligent manslaughter (5).

On the other hand, property crime recorded a total of 5,998 incidents, with notable crimes such as larceny-theft (4,552), burglary (719), motor vehicle theft (711), and arson (16). Compared to the UCR crime report in 2010, the violent crime rate declined from 256.4 per 100K to 251.4 in 2019, while the property crime rate declined dramatically to stabilize around 2,444 in 2019.

There was a turning point in 2019, with violent crime remaining moderate while property crime was significantly higher, especially burglary and theft. The lack of data beyond 2019 made forecasting into 2020 to 2021 challenging. However, stabilization and gradual decline will be possible if societal trends and conditions continue.

Criminal Background Check in Texas

Individuals can conduct a criminal background check at the Texas Department of Public Safety (DPS) through online name-based or fingerprint-based searches. However, employers, landlords, or licensing agencies can only request a person's criminal history or rap sheet with the individual's written consent. Texas law provides some protections to job applicants by prohibiting reports conducted by consumer reporting agencies from including criminal history information older than 7 years in their reports.

Individuals can conduct criminal history checks using any of the following methods:

  • Name-based checks:

Individuals can conduct a name-based check using a Criminal History Conviction Name Search tool under the Texas DPS Crime Records Division. Create an account and enter information such as the person's full name, date of birth, and other identifying details. Contact the DPS Crime Records Service to confirm the mail-in process at (512) 424-2474 or by email at crime_records@dps.texas.gov. The fee for a name-based record check through the DPS is $10.00 per search.

  • Fingerprint-based checks:

IDEMIA implements the Fingerprint Applicant Services of Texas (FAST) and works with the DPS to provide applicant fingerprinting services in Texas. However, individuals in the FAST program will not receive copies of background checks from DPS and should contact the requesting agency to submit fingerprints.

Applicants can contact the DPS Fingerprint Services Unit at (512) 424-2365 or by email at fingerprint.service@dps.texas.gov to request the agency's ORI number for the FAST scheduling system. Once the DPS receives confirmation of the ORI and a FACT Clearinghouse account, the agency will receive a FAST Pass. DPS has a list of acceptable documents applicants should submit to the enrollment agency. The fees for fingerprints submissions include:

  • For Applicants: IDEMIA ($10), DPS ($15), FBI ($12)
  • For Volunteers: IDEMIA ($10), DPS ($15), FBI ($10)

How Long Do Arrests Stay on Your Record in Irving?

Indefinitely. In Irving, an arrest or criminal charge may remain on a person's criminal history record unless sealed or expunged. Arrests often remain on record even if the charges were dismissed, the suspect was found not guilty, or the case was completed with deferred adjudication. The only way to permanently clear an arrest from the record is to file a petition to seal or expunge the incident from the record.

How Can I Get My Record Expunged for Free in Irving?

Under Article 55 of the Texas Code of Criminal Procedure, expunction is a process that orders law enforcement agencies to remove, destroy, or erase arrest records. Some persons do not qualify for record expunction in Irving, Dallas County. For instance:

  • A person convicted of any offense or placed on community supervision for an offense other than a Class C misdemeanor is not eligible for expunction.
  • A person is also not eligible for expunction if the arrest relates to a probation violation warrant or if the person takes off a jurisdiction after being released on bond.

To expunge a criminal record in Irving, file a Petition for Expunction with the Dallas County District Clerk's Office, requesting that the court grant an Order for Expunction. A petitioner may prepare and file the petition with the assistance of a licensed attorney.

The petition may include the following:

  • Personal identification information of the petitioner
  • The offense charged
  • Date of the arrest: the alleged offense occurred
  • Name of the arresting agency and other agencies that may have a record of the arrest.
  • Blank "notice of hearing", so the court can set a hearing on the issue.

In cases where the offense was charged, the petition should contain the following:

  • Name of the court handling the case
  • The cause number for the case
  • How the charge was dismissed or not acquitted
  • The date the charge was resolved.

All petitions must be filed with the court, after which the court will schedule a hearing and send notice of the hearing to the agency in charge. A hearing is usually scheduled no earlier than 30 days after filing. If the petitioner meets all requirements, the court will grant the expunction, and the petitioner must present it to the court for the judge's signature. The signed order must then be submitted to all agencies in custody of the records related to the expunged offense.

An expunction filing fee in Irving, Dallas County, is $350 and is payable to the Dallas County District Clerk. There may be extra costs for making certified copies of the order of expunction. Furthermore, the expunction process may take several months to complete as it involves eligibility assessment, filing, a court hearing, and the final order.

Irving Warrant Search

According to Article 15.01 of the Texas Code of Criminal Procedure Act, an arrest warrant is a written order from a magistrate ordering a peace officer to take a suspect into custody for an offense. The judge may issue a bench warrant after that person fails to appear for the court date as a result of an arrest warrant. To determine the status of an arrest or bench warrant in Irving, visit the warrants division of the Irving Municipal Court at 305 N. O'Connor Road, Irving, TX 75061. The court enters all Class C misdemeanor warrants issued into the regional computer system for in-person access.

However, in-person requesters may call for an immediate arrest upon appearance.

Alternatively, Dallas County provides the Dallas County Wanted online search tool for individuals to search for warrant information. The requester must search by name, case number, citation number, license plate, and demographic information.

Do Irving Warrants Expire?

In Irving, a warrant does not expire until it is served or recalled by the issuing judge. Most felony and misdemeanor warrants are resolved when the suspect or defendant is arrested, posts a bond to guarantee a court appearance, or is dead.
