Hale County Court Records
Hale County court records consist of physical documents and electronically stored information that provide a detailed log of court proceedings, including the time of each event, examination of witnesses, testimonies, admissions, exhibits, and other relevant materials filed with the appropriate clerk after the proceedings of a legal action end. In criminal cases, these records may be compiled with Hale County arrest records before being filed with the court clerk.
Are Court Records Public in Hale County?
According to the Texas Rules of Civil Procedure (ch 67a), civil court records are open records, meaning members of the public are entitled to examine and copy these records should they ever feel the need to. However, specific court records may be sealed upon a party’s written motion showing that the need for the court to protect a private interest clearly outweighs the public’s right of access.
In contrast, criminal records operate by a different set of rules. Under the Code of Criminal Procedure (ch 66.302), these records are generally not accessible to the public unless a federal, state, or regulatory law authorizes access.
