Henderson County Arrest Records

Crime detection, investigation, and prosecution information will not be released if:
- It will interfere with the crime's detection, investigation, or prosecution.
- It will make sure the investigation does not result in conviction or deferred adjudication.
- Such information relates to a threat against a peace officer or detention officer and is collected or disseminated under Texas Government Code § 411.048.
What Do Public Arrest Records Contain?
The following arrest information is available on official government inmate portals:
- The inmate's first and last name
- The inmate's race, age, and gender
- SID and TDCJ numbers
- Maximum sentence date
- Current facility
- Projected release date
- Parole eligibility date
- Offense history (date, offense, sentence date, county, and case number)
Henderson County Arrest Statistics
The Texas Department of Public Safety's (DPS) Crime Report page provides arrest statistics from all law enforcement agencies in the state. In 2023, law enforcement agencies in Henderson County made about 272 arrests for 1254 offenses. As of June 2024, the Henderson County Sheriff's Office made about 90 arrests, with 115 warrants received for service. That same year, the Sheriff's Office Detention Division had 284 admissions to jail, 449 average daily population, and 261 releases.

- By email: To find arrest information for free, individuals can send the inmate's full name and 7-digit TDCJ number to pia@tdcj.texas.gov. The subject line of the email should include the inmate's name. If the TDCJ number is unknown, the requester can provide the exact date of birth or an approximate age and county of conviction.
- By phone: Record seekers can call the TDJC during business hours (Monday to Friday, 8 a.m.-5 p.m.) to find an arrest record. The TDJC provides the following numbers for such services:

- In-person: Customers can visit any of the TDCJ facilities during business hours to submit a request. A fee is required for copies of records.
Another way to find Henderson County arrest records is through federal law enforcement agencies such as the Federal Bureau of Investigation (FBI), U.S. Immigration and Customs Enforcement (ICE), and the United States Capitol Police (USCP). Individuals can visit these agencies in person to conduct a search for a fee. However, most of them have free online databases that can be used to locate information on individuals in federal prisons. For example, the Federal Bureau of Prisons (BOP) uses its Inmate Locator to make arrest information available to the public. The search criteria are number (BOP register number, DCDC number, FBI number, or INS number) or name (first, middle, or last).
Free Arrest Record Search in Henderson County
The Texas Department of Criminal Justice (TDCJ) provides arrest records for free online, by email, and by phone to members of the public. All that is required is to provide the inmate's full name, 7-digit TDCJ number, exact date of birth, or approximate age. Individuals can also use third-party portals to search for a free arrest record using a name or number. Most portals return limited information for free and require a fee for extensive searches. However, inquirers can use such limited information to locate the appropriate record on the official database.
How Long Do Arrests Stay on Your Record?
According to Texas Law, arrest charges involving felonies and misdemeanors remain permanently on a person's record. This does not change even if the person's charges were dismissed, was found not guilty, or has successfully completed deferred adjudication. Individuals can restrict public access to their records through expungement. The Texas State Library & Archives Commission (TSLAC) outlines the retention schedule of some arrest records available to the public. For example:
- Arrest reports are retained for 75 years.
- Arrest records containing police activity logs or dockets are retained for two (2) years.
- Offense investigation records are retained for 75 years or until the date the record holder dies.
- Offense records (first-degree and capital felonies) of cases cleared or dismissed by the court are kept for 50 years.
- Offense records of second and third-degree felony cases the court cleared or dismissed are kept for ten (10) years.
- Offense records of class A and B misdemeanors and state jail felonies cases the court cleared or dismissed are retained for two (2) years.
- Clery act reporting (crime log and statistics) relating to arrests for liquor and drug law violations and illegal weapons possession are retained for seven (7) years.
- Arrest reports and citations for Class C misdemeanors and unclassified violations of state or local law punishable by fine only are retained for six (6) months.
Expunge Henderson County Arrest Records
Henderson County residents can have their arrest records expunged or cleared, or they may petition for their records to be sealed through a nondisclosure order. They have to meet the eligibility criteria set forth in Tex. Code Crim. Proc. § 55. Applicants eligible for expungement can file a Petition for Expunction with the Henderson County District Court, where their arrest cases were heard. Per Tex. Code Crim. Proc. § 102.006, the filing fees cost $350.
After filing the form with the court, a hearing will be held in 30 days. All law enforcement agencies involved in the arrest will be notified of the hearing by mail. Agencies within the court's electronic system will be notified free of charge. However, for agencies outside the system, there is a service fee of $7 per agency, plus an additional $1 per page for copies of the petition and the order setting the hearing. The applicant should bring a drafted Order of Expunction on the hearing day. The court will permit the law enforcement agencies to contest the expungement during the hearing. The Judge will sign the Order for Expunction if the applicant meets the necessary requirements for expungement. The form will be served on all law enforcement agencies with the applicant's arrest records. The fee for this is $7 per agency plus ($1 per page for a copy of the order and $5 per document for certification for serving the Final Order (Granted/Denied). The agencies will delete or return the arrest records to the Henderson County District Court Clerk.
Henderson County Arrest Warrants
The Tex. Code Crim. Proc. § 15.01 defines arrest warrants as written orders issued by magistrates to person officers commanding them to deal with an accused according to the demands of the law. They are usually issued in the name of the state, and they:
- Specify the accused's name. If unknown, a specific description of the person must be provided.
- Specify the offense committed by the accused.
- Must have the magistrate's signature and the name of their office.
An arrest warrant issued in Henderson County extends to all parts of Texas and can be executed in any county in the state. An arrest warrant can be executed at any day or at any time. After executing an arrest warrant, the office must immediately bring the arrested person before the issuing magistrate.
Do Henderson County Arrest Warrants Expire?
According to Texas law, an arrest warrant has no expiration date. They remain valid until the defendant is apprehended.
